Purchase Policy

1. INTRODUCTION

1.1 Planet Ball is the trading name of Planet Ball Limited (a company registered in Ireland under company number 779766), with its registered office in, Ireland. Referred to in this Purchase Policy as "Planet Ball", “we", "us", or "our".

1.2 We operate an online webstore, www.Planetball.ie, where you can purchase official tickets, as well as other items in connection with events. The term "Ticket(s)" refers to official event tickets (i.e., tickets allocated to us directly by Event Partners (as defined below) for sale by us in our capacity as an authorised “Official Agent and Reseller”).

1.3 This "Purchase Policy" outlines the terms and conditions applicable to purchases of Tickets from us. If you are purchasing or wish to purchase Accessible Tickets, please contact us at sales@Planetball.com (note that further terms may apply to Accessible Tickets in addition to this Purchase Policy). If you are making a purchase online, this Purchase Policy also incorporates our website Terms of Use.

1.4 We sell Tickets and associated products and services as Authorised Official ticket agents and resellers for professional sports entities, event organisers, venues, producers, artists/performers, agents, teams, and others involved in organising events ("Event Partner(s)"). Please note that we are not responsible for organising or delivering the events themselves.

1.5 We sell Tickets as and when they are allocated to us by Event Partners, in accordance with our contractual obligations. The number and type of Tickets allocated for sale by us can vary on an event-by-event basis.

1.6 We sell Tickets from multiple online distribution points. However, all distribution points access the same ticketing system and ticket inventory, meaning Tickets for popular events may sell out quickly. We do not control ticket inventory or its availability.

1.7 For all events, we may offer various types of packages:

"Packages": These packages are offered for sale at an inclusive price and include a Ticket along with one or more additional products or services, such as exclusive seating arrangements, accommodation, insurance, transport, dining, tours, or merchandise. These packages are sold at market-driven prices, which can fluctuate up or down after your purchase.

1.8 In this Purchase Policy, we refer to any products and services offered for sale by us (including Tickets, Accommodation, Transport, Insurance, Stadium Tours, and Packages) as "Items".

1.9 Please note that Items cannot be exchanged or refunded after purchase, except as set out in clause 11 of this Purchase Policy.

1.10 Nothing in this Purchase Policy affects your statutory rights as a consumer. For more information about your statutory rights, please contact Citizens Information.

 

2. YOUR ACCOUNT AND OBLIGATIONS

2.1 To set up a Planet Ball account to purchase a Ticket, you must:
(a) Be at least 18 years old (or the age of legal capacity in the country of purchase) and able to enter into legally binding contracts;
(b) Follow the instructions to set up a password-protected account, providing your full name, postal address, telephone number, and email address (all details must be kept up to date at all times).
(c) Once a purchase is made, a Planet Ball account is automatically created for you. Your Planet Ball account will hold your tickets if applicable, as well as any hotel or travel vouchers and package information.
(d) All bookings must be made in the names listed on passports to avoid confusion. The responsibility for possessing a valid passport and/or visa, where necessary, is the responsibility of each individual travelling with any Planet Ball package.
(e) Each individual is solely responsible for presenting themselves at their chosen departure point within the carrier's guidelines.
(f) As a Planet Club member, you will receive updates, news, exclusive offers, surveys, and competitions. To unsubscribe from 'non-essential' communications, click the unsubscribe link at the bottom of the relevant email.

2.2 You are solely responsible for maintaining the security of your username and password and for all activity on your account. You must not allow anyone other than you to use your account. If you become aware or suspect that anyone knows your username and/or password, contact us immediately.

2.3 If you are making purchases on behalf of a company or legal entity, you represent and warrant that you have the authority to bind that company or legal entity (and this Purchase Policy applies to that company or entity).

2.4 Please refer to our Privacy Notice and Cookies Policy for more details on how we use and protect your personal data. If we investigate your account or are being investigated, you agree to cooperate fully with our requests for information about you and your purchases.

2.5 You must not create or use multiple accounts to circumvent any terms of this Purchase Policy or conceal your identity or personal details.

2.6 You must not use our website or your account for any unlawful purpose. If we suspect unlawful activity, we are required by law to report it to the relevant authorities (and any relevant Event Partner).

2.7 We reserve the right to terminate your account and/or cancel your orders if:
(a) Any abusive, threatening, or anti-social behaviour occurs via your account;
(b) We suspect fraudulent or illegal activity;
(c) Unauthorised use of your account is suspected;
(d) We are required by law or a regulatory authority;
(e) You breach this Purchase Policy or other applicable terms.

2.8 You may close your account by contacting us via email at info@Planetball.com. However, closure will not take effect until after any events you have purchased Tickets for have taken place.

2.9 Termination of your account and/or cancellations under this Purchase Policy shall not affect accrued rights and liabilities.

3. LEGALLY BINDING CONTRACT

3.1 In order to make a purchase from us, you must be at least 18 years old (or the age of legal capacity in the country of purchase) and able to enter legally binding contracts. If you are purchasing online, you must also have a Planet Ball account and a valid credit or debit card issued in your name.

3.2 When a purchase is made over the telephone, no binding contract shall exist until you have received a confirmation email.

3.3 There is no requirement for a signed hard copy of this policy. By making a purchase online or via telesales, you agree to accept the terms and conditions of this Purchase Policy.

3.4 Any purchase from us forms a legally binding contract that is subject to: (i) this Purchase Policy; (ii) any special terms and conditions applicable to an Item and/or event; (iii) other terms and conditions of the Event Partner(s) and/or event; and (iv) any venue terms and conditions (including conditions of entry). You should read this Purchase Policy carefully before making a purchase.

3.5 By purchasing one or more Items from us, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Purchase Policy. If you do not agree with this Purchase Policy or any other applicable terms and conditions, or if you cannot comply with any of them, then you must not make a purchase.

3.6 We reserve the right to make changes to this Purchase Policy from time to time. Where we make such changes, we shall post the updated version on our website. Therefore, we recommend that you check this Purchase Policy regularly to stay informed of the current terms and conditions. All purchases are subject to the version of the Purchase Policy that was in place at the time of purchase. If you do not agree with any revised version, you must not make a purchase.

4. PRICES, PAYMENT, AND PLACING ORDERS

4.1 All prices for Items/packages offered for sale are inclusive of VAT in accordance with the Travel Agents Margin Scheme.

4.2 While we make every effort to ensure all advertised prices and quantities are accurate, errors may occur. If we discover an error in the price or quantity of any Item you have ordered, we will inform you as soon as possible and give you the option to confirm your order at the correct price/quantity or cancel your order for a full refund. If we cannot contact you, we may treat the order as cancelled and issue a refund.

4.3 Ticket prices are set at the time of initial on-sale and may remain unchanged for some time or until the event. However, all our Tickets are "market-priced", meaning Sale Prices may increase or decrease at any time based on demand. You will not be entitled to a refund or credit if (a) the Sale Price you paid was higher than a previously lower price; or (ii) the price of any other Tickets for the same event is reduced after you make your purchase.

4.4 Because you can purchase Items in Euro, GBP, or USD, we accept no responsibility for additional charges applied by your credit or debit card provider, or for currency exchange rate fluctuations, which are entirely at your risk.

4.5 For all events, we offer the option to purchase "Missed Event Insurance" in relation to your Tickets from our third-party provider. Please note, this insurance is not covered by this Purchase Policy. Refer to our provider's Missed Event Insurance Terms and Conditions for further details.

4.6 Accepted methods of payment include major debit/credit cards, Visa, MasterCard, American Express, and valid Planet Ball gift vouchers. 

4.7 Your contract for purchase begins once we have confirmed your order and ends immediately after the event for which you purchased the Item(s).

4.8 If you do not receive an order confirmation after submitting payment or experience any issues during the payment process, it is your responsibility to confirm with Planet Ball whether your order has been placed. We are not responsible for costs or losses if you assume an order was placed or not placed without receiving confirmation.

4.9 All purchases are subject to credit or debit card verification, security checks, and collection of payment. Orders may be cancelled if they do not pass our verification process or payment is not received in full. If your payment is recalled by your bank or payment provider, we reserve the right to cancel and refund any order for which a confirmation was sent. We accept no responsibility for cancellations outside our control.

4.10 It is prohibited to use automated devices or software to purchase Items or attempt to do so through illegal or unauthorized activity. We reserve the right to cancel any orders we reasonably suspect to have been made in breach of this Purchase Policy.

4.11 We reserve the right to conduct checks and request additional information to verify purchases. Orders suspected of fraud may be cancelled without notice.

4.12 Please review all details carefully before making a purchase, as we may be unable to rectify issues arising from user error.

4.13 Seating maps displayed during the purchase process are for guidance only. Layouts and seat locations may vary.

4.14 We reserve the right to terminate any contract if anti-social behaviour or misconduct occurs. In such cases, no refund is payable.

4.15 Planet Ball reserves the right to cancel any bookings where pricing errors have occurred.

4.16 In the event of damage to accommodation during your stay, you agree to indemnify us against any claims made against Planet Ball arising from such incidents.

4.17 All deposits paid are non-refundable and non-transferable. If you purchase a package using our deposit scheme, full payment must be made six weeks before the event or six months after the order date, whichever is sooner.

(a) Installments for deposit schemes will be advised at checkout and by follow-up emails.
(b) Failure to pay installments on time may result in the cancellation of your package and loss of all monies paid.
(c) Once fully paid, packages are non-refundable and non-transferable.

4.18 We recommend that customers add ticket refund protection when making a booking. This option is available during the checkout process.

4.19 Packages purchased via www.Planetball.ie are strictly prohibited from resale. Planet Ball reserves the right to cancel without refund any packages purchased for resale purposes. 

4.20 Orders of 10+ packages for any individual event are not permitted within 48 hours without prior agreement. 

5. TICKET DELIVERY

5.1 We aim to dispatch Tickets as early as possible. However, dispatch dates depend on various factors, including when we receive ticket stock from Event Partners. Expect to receive your tickets 24 hours before the event.

5.2 If your Tickets are not received 24 hours before the event , contact us via email at hello@Planetball.com with your order reference number.

5.3 All our tickets are mobile or e-delivery. You are responsible for downloading Tickets from your Planet Ball account or ensuring that you can receive email delivery of your Tickets.

5.4 We are not liable for missed, unclaimed, or failed deliveries if you are unavailable to receive them or fail to download your Tickets.

5.5 We reserve the right to make Tickets available for collection at the venue or another designated collection point. You will be notified if this is necessary, and you may need to provide photo ID and booking confirmation to collect your Tickets.

5.6 It is your responsibility to check your Tickets upon receipt and contact us immediately if there is an issue. Failure to inform us of errors may limit our ability to assist.

6. NAME CHANGES

6.1 You must inform Planet Ball in writing  no later than seven days before your package begins if you need to make name changes.

7. EVENT TICKET RIGHTS AND OBLIGATIONS

7.1 Any Ticket you purchase from us remains the property of the relevant Event Partner and is a personal, revocable license that may be withdrawn, and admission refused, at any time.

7.2 All event Tickets are non-transferable and are valid only for your chosen selection. While we will make every effort to seat all members of your party together, this cannot always be guaranteed.

7.3 All Planet Ball ticket allocations are for the home section only. Under no circumstances are away colours, flags, signs, or banners permitted in the home section.

7.4 Where your Tickets are for allocated seats, you have the right only to seats of a value corresponding to those stated on the Ticket. We, the Event Partner, or the venue reserve the right to provide alternative seats of equivalent or higher value, should this be necessary.

8. TICKET RESTRICTIONS

8.1 When purchasing Tickets from us, you are limited to a specified number of Tickets for each event. This number is displayed on the purchase page.

8.2 You may not resell or transfer your Tickets if prohibited by law.

8.3 Tickets purchased from us may not:
(a) Be used for advertising, promotions, contests, or sweepstakes (or for other such commercial purposes); and/or
(b) Be combined with any hospitality, travel, accommodation, or other merchandise to create a package for sale, unless prior written permission is granted by us and the Event Partner.

9. EVENT TIMINGS AND ADMISSIONS

9.1 Please note that advertised start times of events are subject to change. Door opening and closing times stated in relation to an event are not necessarily indicative of the event’s start or end time, which remains at the discretion of the Event Partner or artist and may be subject to change.

9.2 Tickets are sold subject to the Event Partner’s right to alter or vary the programme of an event due to circumstances beyond their reasonable control without being obliged to refund money or exchange tickets, unless such change is a material alteration, and the Event Partner offers to refund money due to the materiality of the change.

9.3 Efforts will generally be made to admit latecomers at a suitable break in the event, but admission cannot always be guaranteed.

9.4 The event venue may conduct security searches for safety and security purposes and may refuse admission to anyone suspected of breaching the terms and conditions of the event or the Event Partner.

9.5 Admission to events is subject to the venue’s terms of admission, which may include prohibitions on certain items (e.g., laser pens, mobile phones, dogs (except guide dogs), and patrons’ own food and drink). Please check directly with the venue. Unauthorized use of photographic and recording equipment is also prohibited, and any such photos, videos, or recordings may be destroyed or deleted. The use of drones or similar equipment at or near the event venue is strictly prohibited.

9.6 Breach of the venue’s terms and conditions or any unacceptable behaviour likely to cause damage, nuisance, or injury may result in your ejection from the venue.

9.7 Event Partners reserve the right to refuse admission or remove any person from the venue for reasons of public safety. You will not be entitled to a refund in these circumstances, including for wearing away team colours in home team sections or failure to comply with any safety measures.

9.8 Unless expressly authorised by the Event Partner, there will be no pass-outs or re-admissions of any kind.

9.9 By attending an event, you and other patrons agree to being photographed, filmed, and/or recorded in relation to the event and/or for safety and security purposes, including by the police. These photos, videos, and recordings may be used in all media for any purpose, although you may object to such use by contacting info@Planetball.com.

9.10 Prolonged exposure to loud music or noise may damage your hearing. We advise all patrons to wear adequate ear protection at events.

9.11 Special effects, which may include sound, pyrotechnics, or lighting effects, may be featured at some events and may not be suitable for those with photosensitive epilepsy or similar conditions.

10. EVENT CANCELLATIONS AND ALTERATIONS

10.1 If an event is cancelled or rescheduled, we will use reasonable efforts to notify you once we have received information and authorisation from the Event Partner. However, we cannot guarantee that you will be informed of such cancellations, rescheduling, or alterations prior to the event. It is your responsibility to ascertain whether an event has been cancelled or rescheduled and the date and time of any rescheduled event.

10.2 If an event for which you have purchased Tickets is cancelled in full (and not rescheduled), your order will be cancelled, and you will be refunded the Sale Price of your Tickets. If the cancellation occurs within seven days of the event, any hotel as part of the package is non-refundable.

10.3 If an event is rescheduled, your original package will be transferred to the new date.

10.4 All event dates and start times, especially for football events, are subject to change depending on live TV broadcast schedules or cup draws. It is your responsibility to confirm the final date and time. Packages will remain valid for the new confirmed date, and no refunds will be provided if you are unable to attend.

10.5 If an event is rescheduled within seven days of the original date, any hotel bookings as part of a package are non-refundable.

10.6 Planet Ball is not responsible for the cancellation or delay of any ferry or coach service. Advertised itineraries are subject to change, and no refunds will be given in such cases.

10.7 In case an event is postponed due to health risks to the public or unavoidable circumstances, any monies paid will be credited to your customer account (except for hotel costs, if the hotel does not issue a refund).

11. TRAVEL INSURANCE

11.1 We recommend that all customers travelling to an event take out a travel insurance policy before travelling.

12. NO STATUTORY RIGHT TO CANCEL

12.1 You are not entitled to a refund if you change your mind about attending an event or can no longer attend. 

13. INTERPRETATION

13.1 The terms "including", "include", "in particular", "e.g." or similar expressions shall be interpreted as illustrative and shall not limit the scope of the preceding words or terms.

13.2 The headings in this Purchase Policy are for reference purposes only and do not affect its interpretation.

13.3 Capitalised terms in this Purchase Policy have the meaning assigned to them within the policy.

14. WARRANTIES AND INDEMNITIES

14.1 You represent and warrant that the information you submit to us in connection with your account and purchases is true, accurate, and complete, and that you are at least 18 years old (or of legal capacity in your country of purchase) and can enter legally binding contracts.

14.2 You warrant that your use of our website complies with all applicable laws and this Purchase Policy, as well as our website terms of use.

14.3 You agree to indemnify and hold us and our affiliates, officers, employees, and agents harmless from any losses, damages, expenses (including legal fees), claims, or demands arising from your breach of this Purchase Policy or applicable law, or your infringement of any third-party rights.

15. LIMITATION OF LIABILITY

15.1 To the maximum extent permitted by law, we (including our affiliates, parent companies, subsidiaries, and their respective officers, directors, employees, agents, legal representatives, and subcontractors) and our relevant Event Partners shall not be liable for any loss, injury, or damage to any person (including you) or property howsoever caused (including by us or the Event Partner):

(a) In any circumstances where there is no breach of contract or legal duty of care owed by us or the relevant Event Partner;
(b) Where such loss or damage is not a direct result of any such breach (save for death or personal injury resulting from our or the Event Partner's negligence);
(c) To the extent that any increase in any loss or damage results from your negligence or breach of this Purchase Policy, any other applicable terms, or any laws or regulations.

15.2 To the maximum extent permitted by law, we (including our affiliates, parent companies, subsidiaries, and their respective officers, directors, employees, agents, legal representatives, and subcontractors) and our relevant Event Partners shall not be liable for any indirect or consequential losses, including but not limited to loss of data, profits, revenue, goodwill, or opportunity, nor for distress or any exemplary, special, or punitive damages arising directly or indirectly from your use of Planet Ball Services or any purchases made under this Purchase Policy. Specifically:

(a) Personal arrangements and expenditure, such as travel, accommodation, hospitality, and other costs you incur related to an event are at your own risk. Neither we nor the Event Partner shall be responsible for any wasted or unrecoverable costs, even if caused by the cancellation, rescheduling, or alteration of an event.
(b) Neither we nor any Event Partner shall be responsible or liable for loss of enjoyment or amenity, including if an event is cancelled, rescheduled, or altered.
(c) Neither we nor any Event Partner shall be liable if admission to an event is refused or revoked due to your breach of any Event Partner’s terms and conditions.

15.3 Unless otherwise specified in this clause, our and any relevant Event Partner's liability to you in connection with an event (including, but not limited to, for any cancellation, rescheduling, or alteration of an event) and any Items purchased shall be limited to the price paid by you for the Items.

15.4 We are not responsible for internet connection errors experienced while using the Planet Ball Services.

15.5 We are not responsible for the actions or failures of any event venue, performer, promoter, or other Event Partner. Under no circumstances shall we be liable for death or personal injury suffered by you or your guests at an event unless caused by our negligence. Neither shall we be liable for any loss or damage to your property or belongings, or those of any guests under your booking, attending an event.

15.6 We will not be liable for failure to perform any of our obligations under this Purchase Policy to the extent that the failure is caused by a force majeure event (including, without limitation, acts of God, war, riot, civil disturbances, acts of terrorism, fire, flood, theft of essential equipment, strikes, lockouts, extreme weather, third-party injunctions, or government regulations). This clause does not affect terms related to refunds.

15.7 Our responsibility is limited to event tickets and accommodation booked with us. We are not responsible for any additional expenses, loss, damage, injury, inconvenience, or delays resulting from third-party actions. All bookings are accepted subject to the terms and conditions imposed by the hotels, guest houses, or event organisers concerned. Any claims must be made directly to the appropriate parties.

 

16. QUERIES, COMPLAINTS, AND DISPUTE RESOLUTION

16.1 If we need to contact you, we will use the details you provided in your Planet Ball account (or the contact details used at the time of purchase if you did not purchase online). It is your responsibility to keep your contact details up to date. Ensure that you provide a valid email address and check your junk or spam folders regularly for any communication from us.

16.2 During your trip: If you need to make a complaint while on your trip, contact us immediately and we will try to resolve the issue. For hotel-related issues, use the emergency number found in your Dispatch Notification email.

16.3 Post-travel: After your trip, complaints must be submitted in writing via email or recorded post within 28 days of the package completion date. We value your business, and your satisfaction is important to us. All complaints will be thoroughly investigated, and we will work to resolve your issue.

16.4 Your complaint will be acknowledged as soon as possible and in any case, within five business days of receipt.

16.5 We may need to contact one or more Event Partners to gather more information before responding to your query or complaint.

16.6 If a dispute arises, we will make every effort to negotiate in good faith and reach an equitable resolution with you and any relevant Event Partner. Some disputes may take up to 28 days to resolve.

16.7 Although this does not restrict your rights to pursue court proceedings, if we are unable to resolve a dispute through negotiation within 28 days, either party may initiate mediation by giving written notice to the other party.

16.8 Nothing in this Purchase Policy affects your statutory rights.

16.9 We do not tolerate aggressive or abusive behaviour towards our staff or representatives, nor unreasonable demands or persistence. We reserve the right to take any necessary action in response to such behaviour.

17. GENERAL

17.1 If we delay or fail to enforce any provision of this Purchase Policy, it does not mean we have waived our right to enforce it.

17.2 We may assign our rights and obligations under this Purchase Policy, provided your rights are not adversely affected.

17.3 If any provision of this Purchase Policy is found to be invalid or unenforceable by a competent court, that provision shall be deemed omitted, but this shall not prevent the other provisions from remaining in full force.

17.4 If any provision of this Purchase Policy becomes illegal, invalid, or unenforceable in any jurisdiction, it shall not affect the legality, validity, or enforceability of any other provision.

17.5 Nothing in this Purchase Policy or any actions taken by you or us creates, or shall be deemed to create, a partnership, joint venture, or principal-agent relationship.

17.6 Any notice provided under this Purchase Policy shall be delivered upon receipt and is deemed received at the time of delivery (if delivered by hand, registered post, or courier) or at the time of transmission (if delivered by email).

17.7 This Purchase Policy is governed by and construed in accordance with Irish law. You and we agree to submit to the non-exclusive jurisdiction of the Irish courts regarding any disputes arising from this Purchase Policy.

18. PROMOTIONAL OFFERS/COMPETITIONS

18.1 All promotional offers, discounts, and competitions are subject to availability and may be withdrawn or changed at any time without prior notice. Competition winners must agree to have their details published on our website and social media. All decisions are final.

18.2 Promotional offers and discount codes are only available during the specified dates and apply to included products while stock lasts.

18.3 Discount codes can only be used once per person unless otherwise stated.

18.4 Only one discount code/promotion can be applied to an order.

18.5 Discount codes are valid for online orders only and cannot be applied to past orders.

18.6 Restrictions may apply to item quantities for some offers.

18.7 Planet Ball reserves the right to cancel any orders that do not comply with these terms.
